Privacy Policy

Protecting your personal data is important to us. Below we provide comprehensive information about which data is processed when you visit this website and use our services – and which rights you are entitled to under the General Data Protection Regulation (GDPR).

This is a translation for your convenience. The German version is legally binding.

1. Controller

The party responsible for data processing on this website within the meaning of Art. 4 No. 7 GDPR is:

Gille & Reininghaus GbR
“Lake House Ternsche”
Strandweg 19
59379 Selm
Germany

Represented by the partners Katrin Gille and Ralf Reininghaus.

Phone: +49 151 22690959
E-mail: info@lakehouse-ternsche.de

If you have any questions about data protection, please use the contact details given above. We have not appointed a separate data protection officer, as there is no legal obligation to do so.

2. General Information & Legal Bases for Processing

Personal data is any information relating to an identified or identifiable natural person (e. g. name, address, e-mail address, IP address). We process personal data exclusively in accordance with the GDPR and the German Federal Data Protection Act (BDSG) as well as the principle of data minimisation.

Where we require a legal basis for processing operations, the following bases in particular may apply:

  • Art. 6(1)(a) GDPR – consent, where you have granted us such consent for a specific processing purpose (e. g. when loading external content).
  • Art. 6(1)(b) GDPR – processing for the performance of a contract or to carry out pre-contractual measures (e. g. handling a booking or contact enquiry).
  • Art. 6(1)(f) GDPR – safeguarding our legitimate interests, provided that your interests or fundamental rights do not override them (e. g. the secure, technically flawless operation of the website).

We state the relevant legal basis for each individual processing operation in the following sections.

3. Hosting with Mittwald

This website is hosted by an external service provider:

Mittwald CM Service GmbH & Co. KG
Königsberger Straße 4–6
32339 Espelkamp
Germany

The provider stores on our servers the personal data required to deliver and secure the website. Each time the website is accessed, information transmitted by your browser is automatically recorded in so-called server log files. This is in particular:

  • the anonymised or shortened IP address of the requesting device,
  • the date and time of access,
  • the name and URL of the file retrieved,
  • the website from which access was made (referrer URL),
  • the browser used and, where applicable, the operating system of your device as well as the name of your access provider.

This data is processed to ensure trouble-free operation, the security and stability of the systems, and to ward off attacks. This data is not merged with other data sources or evaluated for marketing purposes.

Legal basis: Art. 6(1)(f) GDPR. Our legitimate interest lies in the technically flawless and secure operation of the website. We have concluded a data processing agreement with the hosting provider pursuant to Art. 28 GDPR, which ensures processing in compliance with data protection law.

4. Contact Form & Getting in Touch

If you send us an enquiry via the contact form or by e-mail, we process the data you provide. Via the contact form this is regularly:

  • name,
  • e-mail address,
  • telephone number (optional),
  • subject and content of your message.

The processing serves solely to handle and respond to your enquiry. The information from the contact form is technically sent to us by e-mail and not stored in a database. It is not passed on to third parties.

Legal basis: If your enquiry is aimed at concluding or initiating a contract (e. g. a booking enquiry), Art. 6(1)(b) GDPR is the legal basis. In all other cases, the processing is based on our legitimate interest in responding to enquiries pursuant to Art. 6(1)(f) GDPR.

Erasure: We delete the data arising in connection with your enquiry as soon as it is no longer required for storage – i. e. once your request has been conclusively dealt with – unless statutory retention obligations (e. g. under commercial or tax law) preclude this.

5. Booking & Enquiries via Smoobu

To display availability and to process bookings and booking enquiries, we use the booking system of

Smoobu GmbH
Wattstraße 11
13355 Berlin
Germany

Smoobu provides a calendar or booking widget on our booking page. This widget is not loaded automatically: it is only loaded from the servers of Smoobu GmbH once you actively give your consent to do so (a so-called "click-to-load" procedure). Only when it is loaded can connection data – such as your IP address – be transmitted to Smoobu.

If you then place a booking or enquiry, the booking and contact data you enter (e. g. name, address, e-mail address, travel period, number of persons) is transmitted to Smoobu and processed there to handle the booking.

Legal basis: The loading of the widget takes place on the basis of your consent pursuant to Art. 6(1)(a) GDPR, which you can withdraw at any time with effect for the future. The subsequent processing of your booking and contact data to carry out the booking takes place on the basis of Art. 6(1)(b) GDPR. A data processing agreement pursuant to Art. 28 GDPR exists with Smoobu. Further information can be found in the privacy policy of Smoobu GmbH.

6. Map Display with OpenStreetMap

To show our location, we embed an interactive map on the contact page. The mapping software Leaflet is delivered locally from our own server; in this respect there is no connection to third parties.

The actual map tiles (sections of the map image), however, are loaded from servers of

OpenStreetMap Foundation (OSMF)
St John's Innovation Centre, Cowley Road
Cambridge, CB4 0WS
United Kingdom

When the map tiles are loaded, your IP address is transmitted to the OSMF, as this is technically necessary to deliver the map content to your browser. According to its own statements, the OSMF uses this data exclusively for the purpose of delivering the maps.

Legal basis: Art. 6(1)(f) GDPR. Our legitimate interest lies in an appealing, privacy-friendly presentation of our location and in making it easier for our guests to find their way to us. Further information can be found in the privacy policy of the OpenStreetMap Foundation.

7. Links to Booking Portals

On our website we link to external booking portals such as Airbnb, Booking.com and FeWo-direkt. These are merely links; no data is transmitted to these portals simply by displaying our pages.

Only when you actively click on such a link and switch to the respective portal do you leave our website. From that point on, the operator of the respective portal is the independent controller within the meaning of the GDPR. The data protection provisions of the respective provider, over which we have no influence, apply to the data processing there.

8. Fonts & Libraries (locally hosted)

All fonts used on this website (in particular "Inter" and "Cormorant Garamond") as well as all program libraries used – including the mapping software Leaflet – are delivered locally from our own server. Neither Google Fonts nor other third-party services are integrated, so that when these pages are accessed no connection is established to servers of Google or other third-party providers and no corresponding data is transmitted to third parties. The only exception is the services described under sections 5 and 6 (Smoobu, OpenStreetMap).

9. Cookies & Local Storage

This website uses no tracking or marketing cookies and dispenses with analytics or profiling services.

We use exclusively technically necessary entries in your browser's local storage (localStorage). This stores in particular your decision regarding the loading of external content (consent flag), so that you do not have to make your choice again on every visit. This data remains exclusively on your device, is not transmitted to us or to third parties, and can be deleted by you at any time via your browser settings.

Legal basis: For technically necessary storage operations, Section 25(2) TDDDG; insofar as this involves the processing of personal data, Art. 6(1)(f) GDPR.

10. Your Rights as a Data Subject

Within the framework of the statutory provisions, you have the following rights with regard to your personal data:

  • Access to the data stored about you (Art. 15 GDPR),
  • Rectification of inaccurate or incomplete data (Art. 16 GDPR),
  • Erasure of your data (Art. 17 GDPR),
  • Restriction of processing (Art. 18 GDPR),
  • Data portability (Art. 20 GDPR),
  • Objection to processing based on Art. 6(1)(f) GDPR (Art. 21 GDPR),
  • Withdrawal of consent given with effect for the future (Art. 7(3) GDPR).

To exercise your rights, an informal message to the contact details given under section 1 is sufficient.

11. Right to Lodge a Complaint with a Supervisory Authority

Without prejudice to any other legal remedies, you have the right to lodge a complaint with a data protection supervisory authority if you believe that the processing of your data infringes the GDPR (Art. 77 GDPR). The supervisory authority responsible for us is:

Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen (LDI NRW)
Kavalleriestraße 2–4
40213 Düsseldorf
Germany
Phone: +49 211 38424-0
E-mail: poststelle@ldi.nrw.de

12. SSL/TLS Encryption

For security reasons and to protect the transmission of confidential content – such as the enquiries you send us – this website uses SSL/TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the padlock symbol in your browser bar. When encryption is active, the data you transmit to us cannot be read by third parties.

13. Status & Currency of This Policy

We reserve the right to amend this privacy policy so that it always complies with current legal requirements or to implement changes to our services. The respective current version then applies to your next visit.
